Preamble
These Terms of Use, hereinafter the "ToU", are intended to define the conditions for accessing and using the website and online shop operated under the trade name Yaya's Creative Studio, hereinafter the "Site".
The terms "we", "our" and "us" refer to Yaya's Creative Studio.
The Site is hosted and runs on the Shopify platform, which provides us with the technical tools necessary for presenting our products, managing the online shop and processing orders.
These ToU concern solely access to the Site and its use.
Sales made through the Site are governed by our Terms and Conditions of Sale, hereinafter the "T&Cs", available on the Site.
The processing of personal data is described in our Privacy Policy. The use of cookies and other trackers is described in our Privacy Policy or our Cookie Policy, where a separate policy is available.
By accessing the Site or using its features, the user acknowledges that they have read these ToU and undertakes to comply with them.
If the user does not accept these ToU, they must stop using the Site.

Article 2. Purpose and scope
These ToU apply to anyone accessing the Site, browsing it or using any of its features, hereinafter the "User".
They govern in particular:

  • browsing the Site;
  • the creation and use of a customer account;
  • the use of interactive features;
  • the possible publication of reviews or comments;
  • access to the content, photographs, texts and graphic elements;
  • the use of the technical tools offered on the Site.

These ToU do not replace the T&Cs.
All questions concerning products, orders, prices, payments, delivery, the right of withdrawal, returns, refunds and legal guarantees are governed by the T&Cs in force at the time of the order.
In the event of a conflict between these ToU and the T&Cs concerning an order or a sale, the T&Cs prevail.

Article 3. Access to the Site
The Site is in principle accessible free of charge to anyone with access to the Internet.
The costs relating to the Internet connection, computer equipment, telephone, software or any other equipment necessary to access the Site remain the responsibility of the User.
The User is responsible for the proper functioning and security of their own equipment.
Yaya's Creative Studio endeavours to keep the Site accessible and functional.
Access to the Site may, however, be temporarily interrupted, restricted or suspended, in particular in the event of:

  • maintenance;
  • updates;
  • a technical change;
  • a problem affecting Shopify or another technical provider;
  • an Internet network failure;
  • a risk to the security of the Site;
  • an attempted fraudulent access;
  • an event beyond our reasonable control.

Yaya's Creative Studio does not guarantee that the Site will be permanently accessible, without interruption or technical error.
Where reasonably possible, we endeavour to limit the duration of interruptions.
A temporary interruption of the Site does not affect the customer's legal rights concerning an order already concluded.

Article 4. Capacity and use by minors
The User must have the legal capacity necessary to use the features of the Site that involve entering into a commitment.
A minor may browse the Site under the responsibility of their legal representative.
Any order placed by a minor must be made with the authorisation and under the responsibility of their legal representative.
The legal representative is responsible for supervising the minor's use of the Site and for compliance with these ToU.

Article 5. Customer account
Certain features of the Site may allow or require the creation of a customer account.
When creating or using an account, the User undertakes to provide accurate, complete and up-to-date information.
The User is responsible for:

  • the confidentiality of their credentials;
  • the choice and security of their password;
  • the activities carried out through their account;
  • keeping the information associated with their account up to date.

The customer account is personal.
The User must not:

  • sell their account;
  • transfer their account to a third party;
  • deliberately share their credentials with a third party;
  • use another person's account without authorisation;
  • create an account under a false identity.

In the event of loss of credentials, unauthorised access or suspected fraudulent use, the User must change their password and contact us as soon as possible at:

The User may request the closure of their account by contacting us at this same address.
Closing the account does not result in the immediate deletion of information that must be kept in order to comply with a legal, accounting, tax or contractual obligation, or in connection with the defence of our rights.
Creating an account is not mandatory where the Site allows ordering as a guest.

Article 6. Accuracy of the information provided by the User
The User undertakes not to provide information that is deliberately false, misleading, fraudulent or belonging to another person.
When using the Site or placing an order, the User must in particular provide accurate information concerning:

  • their identity;
  • their email address;
  • their billing address;
  • their delivery address;
  • the information necessary to process their request or order.

The User is invited to update their information when it changes.
Yaya's Creative Studio cannot be held responsible for an inability to contact the User or to correctly carry out a request resulting from information that is incorrect, incomplete or not updated by the User.
This provision does not limit the legal obligations of Yaya's Creative Studio concerning validly concluded orders.

Article 7. Information and content available on the Site
Yaya's Creative Studio endeavours to present information that is accurate, understandable and regularly updated.
The Site may in particular contain:

  • product descriptions;
  • photographs;
  • information relating to materials;
  • usage instructions;
  • creative advice;
  • tutorials;
  • articles;
  • informational content;
  • information relating to availability or timeframes.

General information, advice, tutorials and editorial content are provided for information purposes.
They do not replace the precautions, instructions or warnings appearing on the product, its packaging or its instructions.
The essential characteristics, the price and the conditions applicable to an order are those presented to the customer before that order is validated, in accordance with the T&Cs.
Typographical errors, inaccuracies or omissions may exceptionally appear on the Site.
Yaya's Creative Studio may correct or update this information as soon as an error is identified.
The arrangements applicable when an error affects an order are specified in the T&Cs.

Article 8. Intellectual property
The Site and all the elements that make it up are protected by the French, European and international rules applicable to intellectual property.
These elements include in particular:

  • the name Yaya's Creative Studio;
  • the logos;
  • the visual identity;
  • the texts;
  • the photographs;
  • the illustrations;
  • the drawings;
  • the patterns;
  • the graphics;
  • the videos;
  • the sound elements;
  • the product pages;
  • the presentations;
  • the layout;
  • the structure of the Site;
  • the creative content;
  • the databases.

These elements are the property of Yaya's Creative Studio or are used with the authorisation of their respective holders.
Access to the Site confers no intellectual property rights on these elements to the User.
The User is authorised to browse the Site and use its features for their personal and non-commercial needs.
Unless prior written authorisation is given or an exception is provided for by law, it is prohibited to:

  • reproduce all or part of the Site;
  • copy or download the photographs or illustrations for commercial purposes;
  • modify or adapt the content;
  • publish the content on another site;
  • distribute or resell the content;
  • create a derivative work from the content;
  • extract or reuse a substantial part of a database;
  • use the trademarks, logos or visual elements of Yaya's Creative Studio;
  • present the content as being that of another creator or trader;
  • give the impression of a partnership or authorisation that does not exist.

The names, trademarks, logos and content belonging to Shopify or other third parties remain the property of their respective holders.
All rights not expressly granted to the User are reserved.

Article 9. Reviews, comments and other contributions
The Site may allow Users to transmit or publish reviews, comments, suggestions, photographs or other content, hereinafter the "Contributions".
The User remains the holder of the rights they hold in their Contributions.
By transmitting a Contribution for the purpose of having it published on the Site, the User grants Yaya's Creative Studio a non-exclusive, free-of-charge authorisation allowing us to:

  • host the Contribution;
  • reproduce it on the Site;
  • display it publicly on the Site;
  • adapt it only where necessary for its technical presentation;
  • keep it for the time necessary for its publication and the management of the service concerned.

This authorisation is limited to the needs of operating, presenting and promoting the Site and the activities of Yaya's Creative Studio.
It does not transfer ownership of the Contribution to Yaya's Creative Studio.
The User warrants that they hold the rights and authorisations necessary to transmit or publish the Contribution.
They undertake that their Contributions:

  • are truthful when they constitute a review;
  • do not infringe the copyright or trademarks of a third party;
  • do not infringe the image rights or privacy of a third party;
  • do not contain defamatory, abusive, threatening or discriminatory statements;
  • do not contain personal information concerning a third party without their authorisation;
  • do not contain unlawful or clearly misleading content;
  • do not contain viruses, malware or dangerous links;
  • do not present as independent a review that has been the subject of undisclosed consideration.

Yaya's Creative Studio may refuse to publish or remove a Contribution that is clearly unlawful, fraudulent, offensive, off-topic or infringing the rights of a third party.
Yaya's Creative Studio may also make the corrections strictly necessary for formatting, in particular concerning spacing or typographical errors, without altering the meaning of the review.
The User is responsible for the content they publish under the conditions provided for by law.

Photographs and content provided for a personalised order
The photographs, texts and information transmitted by the customer to produce a personalised order are used for the purpose of processing and producing that order.
Their transmission does not constitute general authorisation for publication or advertising use.
Any promotional use of a photograph provided by the customer or of content that makes it possible to identify a person may be subject to a separate authorisation.

Article 10. Reporting unlawful content or use
Anyone who believes that content published on the Site infringes their rights or is clearly unlawful may report it to us at:

The report should, as far as possible, indicate:

  • the identity and contact details of the person making the report;
  • the precise location of the content concerned;
  • a description of the content;
  • the reasons why the content is considered unlawful;
  • any useful supporting documents;
  • any information allowing the request to be examined.

Yaya's Creative Studio may request additional information where necessary to process the report.
Content may be removed or made inaccessible when it appears clearly unlawful or when a competent authority requests its removal.

Article 11. Prohibited uses
The User undertakes to use the Site in a lawful and fair manner that respects the rights of Yaya's Creative Studio, other Users and third parties.
It is in particular prohibited:

  • to use the Site for fraudulent or unlawful purposes;
  • to impersonate a person or organisation;
  • to create an account using deliberately false information;
  • to use a means of payment without authorisation;
  • to access another User's account;
  • to attempt to gain unauthorised access to the Site, its servers or its databases;
  • to circumvent a security measure;
  • to introduce a virus, malware or harmful code;
  • to deliberately disrupt or overload the operation of the Site;
  • to use a robot, scraper or other automated system to extract data in bulk;
  • to collect the personal data of other people without a legal basis;
  • to send spam or unsolicited communications;
  • to publish false or misleading information;
  • to harass, threaten, insult or defame a person;
  • to infringe the intellectual property rights of Yaya's Creative Studio or a third party;
  • to reproduce, resell or commercially exploit all or part of the Site without authorisation;
  • to use the Site in a way likely to harm its security, operation or reputation.

Article 12. Suspension or restriction of access
Yaya's Creative Studio may suspend or restrict a User's access to all or part of the Site for a legitimate reason, in particular:

  • serious or repeated breach of these ToU;
  • fraudulent use;
  • a breach of the security of the Site;
  • an attempt at unauthorised access;
  • the use of an account belonging to a third party;
  • repeated publication of clearly unlawful content;
  • behaviour likely to cause harm to Yaya's Creative Studio, other Users or a third party.

The measure taken must be proportionate to the seriousness of the observed behaviour.
Where reasonably possible and without compromising the security of the Site, the User may be informed of the reason for the suspension.
The suspension of an account or of access to the Site does not automatically result in the cancellation of orders already accepted.
Ongoing orders remain governed by the T&Cs and by the consumer's mandatory rights.

Article 13. Tools and services provided by third parties
The Site may integrate tools, features or services provided by third parties, in particular:

  • Shopify;
  • payment providers;
  • carriers;
  • email sending services;
  • audience analytics tools;
  • social networks;
  • apps added to the shop.

Some of these features may be subject to the conditions and policies specific to the provider concerned.
Yaya's Creative Studio does not necessarily control the technical operation of all these third-party services.
We choose our providers with care, but cannot guarantee the complete absence of interruption or error originating exclusively from a third-party service and beyond our reasonable control.
This provision does not limit the liability of Yaya's Creative Studio concerning the performance of the sales contracts concluded with consumers.

Article 14. Links to third-party sites
The Site may contain links to websites or services operated by third parties.
These links may in particular provide access:

  • to a social network;
  • to a carrier's website;
  • to a payment provider;
  • to a tracking tool;
  • to an external resource;
  • to embedded content.

Yaya's Creative Studio does not necessarily control the content, availability or practices of these third-party sites.
The User is invited to consult their terms of use and privacy policies before sharing information with them or carrying out a transaction.
Contracts concluded directly with a third party are governed by that third party's conditions.
Any complaint concerning a product or service purchased directly from a third party must be addressed to the third party concerned.

Article 15. Relationship with Shopify
The Site uses the Shopify technical platform.
Shopify enables in particular the hosting of the shop, the presentation of products and the integration of certain order and payment features.
The products offered on the Site are, however, sold directly by Yaya's Creative Studio.
Shopify is not the seller of the products offered by Yaya's Creative Studio.
Any question concerning:

  • a product;
  • an order;
  • a delivery;
  • a return;
  • a refund;
  • a guarantee;
  • a complaint relating to a sale,

Certain data may be processed by Shopify in order to host the Site and provide its features.
The corresponding information is specified in our Privacy Policy.

Article 16. Personal data and cookies
The personal data collected through the Site is processed in accordance with our Privacy Policy, the General Data Protection Regulation and the French Data Protection Act (Loi Informatique et Libertés).
The Privacy Policy specifies in particular:

  • the categories of data collected;
  • the purposes of the processing;
  • the legal bases used;
  • the recipients of the data;
  • the retention periods;
  • any international transfers;
  • the rights of the data subjects;
  • the means of exercising these rights.

Under the conditions provided for by the regulations, the User may in particular have the rights of access, rectification, erasure, objection, restriction and portability.

The Site may use cookies and other trackers necessary for its operation or intended to measure its audience, personalise certain features or offer suitable content.
Where the regulations require it, non-essential cookies are only placed after obtaining the User's consent.
The User can manage their preferences using the cookie management tool available on the Site.
The Privacy Policy must be consulted separately from these ToU.

Article 17. Liability relating to use of the Site
Yaya's Creative Studio endeavours to ensure the security, accessibility and proper functioning of the Site.
We cannot, however, guarantee that the Site will be constantly free of:

  • interruption;
  • slowdown;
  • technical error;
  • failure originating from the Internet network;
  • problem originating from the User's equipment or software;
  • disruption originating exclusively from a third-party provider;
  • a cyberattack despite the measures reasonably put in place.

Yaya's Creative Studio cannot be held responsible for damage resulting exclusively from:

  • use of the Site contrary to these ToU;
  • a fault of the User;
  • the use of defective equipment or software;
  • the deliberate sharing of the account credentials with a third party;
  • an unauthorised intervention by the User on the Site;
  • an event of force majeure within the meaning of French law.

The User must take reasonable precautions to protect their equipment, data and credentials.
No provision of these ToU limits or excludes the liability of Yaya's Creative Studio where the law prohibits it.
In particular, these ToU do not limit:

  • the rights arising from an order;
  • the legal guarantees;
  • the right of withdrawal where applicable;
  • the right to compensation in the event of a breach attributable to Yaya's Creative Studio;
  • liability in the event of personal injury;
  • liability in the event of wilful misconduct or gross negligence;
  • the other mandatory rights granted to consumers.

Article 18. User's liability
The User may be held liable, under ordinary law, for the damage they directly cause to Yaya's Creative Studio or to a third party as a result of fraudulent or unlawful use of the Site.
This may in particular concern:

  • a deliberate breach of the security of the Site;
  • the fraudulent use of an account;
  • the introduction of malware;
  • the publication of unlawful content;
  • the impersonation of a third party;
  • an infringement of intellectual property rights;
  • the automated and unauthorised extraction of data.

This article establishes no automatic obligation to indemnify on the part of the User.
Any liability of the User is assessed in accordance with the applicable law and according to the damage actually caused.

Article 19. Amendment of these ToU
Yaya's Creative Studio may amend these ToU in order to take account in particular of:

  • a legislative or regulatory change;
  • a change in how the Site operates;
  • a new feature;
  • a technical change;
  • a change in the services provided by Shopify or another provider;
  • a security measure.

The most recent version of the ToU is published on this page with its update date.
The changes apply from their effective date.
Where a substantial change affects the rights of a User with an account, that User may be informed by an appropriate means where the law requires it.
Changes to the ToU do not retroactively alter the conditions applicable to orders already concluded.
These orders remain governed by the T&Cs accepted at the time they were validated.

Article 20. Severability
If a provision of these ToU is declared unlawful, void or unenforceable, that provision is deemed severable from the other provisions.
The other provisions remain valid and enforceable to the fullest extent permitted by law.

Article 21. No waiver
The failure of Yaya's Creative Studio to immediately exercise a right or to immediately invoke a breach of these ToU does not constitute a waiver of that right.
Any waiver must be express and limited to the situation concerned.

Article 22. Governing law and dispute resolution
These ToU are governed by French law.
The application of French law does not deprive a consumer residing in another State of the more protective mandatory provisions they may benefit from under the applicable law.
In the event of difficulty concerning the use of the Site, the User is invited to contact us as a priority in order to seek an amicable solution:

Disputes concerning an order, a sale, a delivery, a return, a refund or a guarantee are handled in accordance with the provisions of the T&Cs, in particular those relating to complaints, consumer mediation and the competent courts.
Failing an amicable solution, the dispute falls within the jurisdiction of the competent courts in accordance with the applicable legal rules.
No provision of these ToU deprives a consumer of their right to bring the matter before the competent court provided for by law.
